Welcome to the COMBAT App, a Comprehensive Online Management and Biosecurity Assessment Tool developed and provided by Boehringer Ingelheim Vetmedica GmbH (hereinafter “BI” or “Boehringer Ingelheim”).

Successful PRRS control incorporates measures to reduce both existing PRRS virus spread and new virus introduction. COMBAT is a Comprehensive Online Management and Biosecurity Assessment Tool, developed by Boehringer Ingelheim to facilitate a fast assessment and improvement of the most relevant risks factors related with PRRS control.

With COMBAT you can do an assessment of your internal, external, location and management risks, review the results and benchmark your evaluations and receive some recommendations for action based on the information provided. This online COMBAT solution facilitates improved biosecurity, pig flow and management practices by assessing the most important risk areas related to PRRS incidence.

1. Your Agreement

1.1. These Terms of Use apply to every user of this app, registered or not, provided by Boehringer Ingelheim regardless of the place of access in order to access the information and use the services provided thereon (hereinafter “you”, “yours” etc.).
1.2. By using the service provided thereon and/or by clicking on the corresponding field during the registration of your user account, you enter into a user contract relationship with BI and agree to the binding validity of these Terms of Use. BI shall not recognize any conflicting or deviating terms and conditions on your part, unless BI has expressly agreed to them.
1.3. The access and use of COMBAT is free of charge for both registered and not registered users.

2. Addressees

COMBAT is intended to be an international resource for general purpose information. Accordingly, the content and service provided is international in nature and is not intended to target users in any particular country. Please be aware that country-specific information and considerations may be more relevant to you, which in some cases may differ from the general information and assumptions provided on this app for the services.

3. Use of Content, Intellectual Property and grant of rights

3.1. All content on this app is the property of the Boehringer Ingelheim group of companies (“Boehringer Ingelheim Group”) and is protected by copyright. We permit you to use texts, documents, reports or parts hereof (such as white papers, news releases, datasheets and FAQs) from this app, provided that (1) this notice appears in all copies and that, in particular, both the copyright notice and this permission notice appear, (2) use of such documents from this app is for informational, media and non-commercial or personal use only and the documents will not be copied or posted on any medium available to third parties including but not limited to third party apps or broadcast in commercial media, and (3) no modifications of any documents are made.
3.2. Permission given above does not include the use of the design or layout of this Boehringer Ingelheim app or any other app owned, operated, licensed or controlled by one of the companies of the Boehringer Ingelheim Group. Also, elements of these app are protected by copyright, trade dress, trademark, unfair competition, and other laws and may not be copied or imitated in whole or in part. No trademarks, logos, graphics, sounds or images from this Boehringer Ingelheim app may be copied or retransmitted except as set forth in these Terms of Use above or unless expressly permitted by the specific Boehringer Ingelheim company owning these rights.
3.3. Use for any other purpose is expressly prohibited and may result in severe civil and criminal penalties. Violations will be prosecuted. Any rights not expressly granted herein are reserved.
3.4. You shall retain all intellectual property rights (where available) to your data. Notwithstanding the foregoing, in order to use the COMBAT app, you are required to grant BI the limited rights of use to your data as set forth below:
- (a) By submitting to or making available your data within COMBAT app, you grant BI (including its sub-contractors engaged in the provision and operation of the COMBAT app) a free-of-charge, non-exclusive and worldwide right to use your data and amendments thereof, exclusively for the use in connection with the provision and operation of the COMBAT app (or any parts thereof). This includes the right to reproduce and publicly make available your data in the COMBAT and amendments thereof for the purpose of providing the app and the COMBAT solution to work. The rights of use to your data expire as soon as you remove it from the COMBAT app or delete your user account if registered.
- (b) With regard to the data collected within the use of the COMBAT app concerning actions taken by you for the purpose of assessment, reports, recommendations or suggestions, or benchmark (hereinafter “User Data”), you grant BI a comprehensive, free-of-charge, perpetual, non-exclusive, transferable and sublicensable worldwide right to use User Data in anonymized form for purposes of (a) calculate averages for each farm type and country for benchmark as part of the report, (b) optimizing and improving products and services related and unrelated to the COMBAT solution, (c) developing new features, products and services related and unrelated the COMBAT solution and/or (d) training/education, science/research and/or writing manuscripts, all for BI and BI Affiliates (also referred to herein as “Boehringer Ingelheim Group”) and/or third parties. In this context, “BI Affiliates” are entities that directly or indirectly, through one or more intermediaries, control, are controlled by or are under common control with BI, whereby ‘control’ means with respect to any entity the possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of such entity, whether through the ownership, directly or indirectly, of more than fifty (50) percent of the shares, equity rights or voting rights or other interests of any such entity and/or by contract. The grant of rights of this Section 3.4(b) also includes the right to analyze, amend, combine and/or aggregate User Data with other non-personal data of the user, registered or not, or third parties. The User Data is anonymized in such a way that it cannot be attributed to you or an individual farm.
3.5.
With the exception of User Data, BI is and remains the sole owner or licensee of all intellectual property rights to COMBAT and app, including intellectual property rights to (a) the underlying software, systems, databases, tools, graphics, texts, images, icons and sounds, (b) BI’s trademarks, logos, designs, company signs and work titles as well as (c) tables and graphs within the underlying software.
3.6. You are not entitled and shall not be permitted without the prior explicit written approval by BI to access and use the COMBAT app in any way that runs contrary to these Terms of Use, nor to lend support to such a use in any way. You explicitly agree
- a) not to use the COMBAT, app or content commercially in a way that competes with BI’s business,
- b) decompile, disassemble or reverse engineer the COMBAT solution or app (or any parts thereof);
- c) transfer and/or sublicense any rights granted concerning the COMBAT app (or any parts thereof);
- d) translate, amend, arrange, otherwise modify and further process the COMBAT app and to reproduce the results obtained in this way;
- e) circumvent any technical restrictions; access or attempt to access or use the COMBAT app’ source code or databases and
- f) rent, lease or otherwise commercially transfer the COMBAT app to third parties or otherwise distribute, publicly perform or make available copies of the COMBAT app.

4. Registration

4.1. When registering, you must provide the required data completely and truthfully. In case your data changes after registration, you must update your data immediately. BI is entitled to exclude you from the use of the COMBAT app if you (a) provide false information during registration or (b) do not update this information immediately after it has changed. The administrator of the COMBAT app (hereinafter the “Admin”) is also entitled to exercise the rights subject to this Section.
4.2. Each user account must refer to a specific natural person. The user account is not transferable.
4.3. You must carefully protect access to your user account by keeping your password secret. You hereby warrant that you will not disclose your password to any third party and that you will not deposit or store it in a place from which it can be copied or used by other persons. You must immediately notify BI in written or text form (e.g. email) of any loss, unauthorized disclosure or theft of your password, so that BI can invalidate the respective user account and assign new user account credentials.
4.4. You are responsible for all actions taken with your user account within this app, even if the action in question was not authorized or intended by you. You are liable for all damages caused via your user account by yourself or by third parties, unless you have not culpably caused the damage.
4.5. You may terminate your user contract relationship at any time with immediate effect by deletion your registered account or sending BI a notice of termination (e.g. by email) to delete your user account. Upon receipt of the termination or deletion request, BI will delete your user account and you will no longer have access to the reports created and data provided.

5. Trademark notice

The tradenames of Boehringer Ingelheim products referenced herein, whether or not appearing in bold characters or with the trademark symbol ®, are trademarks of entities of the Boehringer Ingelheim Group or its licensors. The names of actual companies and products mentioned herein may be the trademarks of their respective owners. The use of these trademarks, of the company name Boehringer Ingelheim and the company logo, except as permitted herein, is expressly prohibited and may be in violation of criminal law. The products discussed herein may have different tradenames, different labelling, product presentation and strength in different countries. Please contact our local affiliate in case clarification is requested.

6. Disclaimer

6.1. You acknowledge and agree that COMBAT app must solely be used for their intended purpose. This solely comprises that COMBAT is designed, developed and operated merely as an aid and support tool to facilitate a fast assessment of the data provided by user and improvement of the most relevant risks factors related with PRRS control. The information, data, reports, assessment results, recommendations or suggestions cannot replace a detailed regular assessment of the site and additional relevant factors.
6.2. The Boehringer Ingelheim Group makes no (contractual) representations about the suitability of the information, data, reports, assessment results, recommendations or suggestions contained in the documents and related graphics published on this app for any purpose. All such documents and related graphics are provided “as is” without warranty of any kind.
6.3. The Boehringer Ingelheim Group hereby disclaims all representations, warranties and conditions with regard to this information, data, reports, assessment results, recommendations or suggestions, including all implied warranties, fitness for a particular purpose, title and non-infringement. All access and use of and the content and services of the app thereof is at the own risk of the user. In no event shall entities of the Boehringer Ingelheim Group be liable for any damage or loss whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of information available or generated from this app.
6.4. Any and all information on this app (including information about products, diseases and their treatment) is not intended to be a substitute for consulting with a veterinary physician or professional expert as the case may be. The app is in no way intended to offer a medical diagnosis or patient-specific treatment advice. If you require advice on a specific health problem, please consult a veterinary physician.

The documents and related graphics published or generated on this app could include technical inaccuracies, typographical and other errors. Content may be amended and/or removed at any time without prior notice. The Boehringer Ingelheim Group may make improvements and/or changes in the information, services and COMBAT described and/or provided herein at any time.

7. Notices regarding software, documents and services available on this app

In no event shall the Boehringer Ingelheim Group be liable for any damage or loss, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of software, documents, data, reports, assessment results, recommendations, suggestions, provision of or failure to provide services, or information available from this app.

8. Disclaimer for Third Party Links and Apps

Our app may contain links (hyperlinks/references) to other apps or websites that are operated by third parties or other entities belonging to the Boehringer Ingelheim group of companies. The content of linked sites is beyond our control. The responsibility for the content lies solely with the operators of the linked sites. Links are offered for convenience only; they do not imply a recommendation or endorsement by us. Therefore, Boehringer Ingelheim does neither accept any responsibility for the content and availability of linked sites nor any liability for any damages or injuries of any kind in connection with the content of such sites. Users access linked apps at their own responsibility and are subject to the cookie, privacy and legal policies of the linked site. 9. Queries, Feedback and User Generated Content

Queries and other feedback addressed to Boehringer Ingelheim through this website should not contain questions on personal health matters or on specific prescription-only products, for which you should refer to your relevant physician.

To the extent the app permits you to contribute data or user generated content to the app (e.g., comments, questions or the adding of discussions etc.), you must ensure that such content is honest, accurate, non-misleading, non-promotional, non-commercial, inoffensive and compliant with all applicable laws and regulations. We will monitor such content regularly and remove non-compliant content without notice.

All queries, feedback and user generated content (including questions, comments, suggestions, or the like) shall be deemed to be non-proprietary and non-confidential. The Boehringer Ingelheim Group shall have no obligation of any kind with respect to such information and shall be free to reproduce, use, disclose, and distribute – however, where required by applicable privacy legislation, only in anonymized form – this information to others without limitation. You expressly consent to our monitoring all such information for pharmacovigilance and other regulatory purposes and making appropriate notifications. We may contact you in order to obtain follow-up information, if this is required.

10. Data protection

The protection of your data is very important to BI. To the extent that BI processes personal data from you in the course of the COMBAT app, this takes place exclusively in accordance with applicable data protection law, in particular the EU General Data Protection Regulation (GDPR). 11. Modifications and amendments

BI reserves the right to change and/or amend these Terms of Use with future effect, provided that this is reasonable for you under consideration of BI’s interests and will inform you about such changes and/or amendments in due time. In case you object to the validity of the new Terms of Use, you can proceed to delete your registered user account and deinstall the COMBAT app at any time. Please be aware that you will no longer be able to access all your data, including but not limited to reports, assessment results, recommendations or suggestions upon deletion of your user account.

12. Applicable law and severability

12.1. The user contract relationship under these Terms of Use are exclusively governed by the substantive law of the Federal Republic of Germany, to the exclusion of conflict of law rules of private international law, the Rome Convention on the law applicable to contractual obligations and the United Nations (UN) Convention on contracts for the international sale of goods (CISG).
12.2. If any clause of these Terms of Use is invalid or unenforceable or becomes invalid or unenforceable after conclusion of the use relationship, nothing in this shall prejudice the validity of the remaining provisions hereof. The same applies by analogy to any unintended omission herein.

RSS newsfeeds

The use of the Boehringer Ingelheim RSS newsfeeds is subject to these Terms of Use. Boehringer Ingelheim reserves the right to discontinue this service at any time.
